UCMJ and this marine question

Do you think this marine is trying make it so he is not responsible for the damage to his body so as to not face punishment from the Corp and the UCMJ? I hope the lawyer for the players looks into this aspect.

The guy was involved in a fight, ok?

damage to his body has nothing to do with UCMJ. Drunk and Disorderly (Article 134), however, is definitely punishable - but if he plays the "I was defending myself", he'll probably be OK. If he was underage, that's another consideration for the military....

I can tell you that he'd definitely have to answer for any kind of fight--his fault or otherwise--and that it wouldn't be looked upon favorably. I don't think, however, that he'd risk a lot more trouble by lying to police and instigating a drawn out investigation just to avoid some EMI.
You never know, though.

Thanks for the input. I have been out of the military for awhile now and forget how all that goes down.

does anyone know whether the "marine" is on active duty? or is he in the reserves?
that has a major impact....if he's a reservist not in any sort of duty status, then UCMJ action might not be relevant....but there are always other things that can be done!!!

is there any more to the story that he was harassing the girl both he and JJ were friends with? Man, I'd really like to know what happened. I don't know JJ and this isn't an attempt to have his side but he doesn't seem like the type to let something like that get inside of his head...

What is the story at this point? The marine was trying to leave the parking lot, beeped his horn and the 4 lsu guys kicked his head through the uprights?

He should get some form of punishment. ESP if he was underage. Solider in my unit got into a fight at a bar that was defending himself and he's got 15/15(days of extra duty and forefeiture of 15 days of pay).

He's a reservist
He can still get in trouble in other ways though

Depends. If, in fact, he was dragged from his vehicle and beaten for merely honking his horn, then I would not charge him under UCMJ.
(note: not saying that's what happened, since none of us really know......)

I'm having a hard time wading through all the bullshite...
First I heard that some guy honked, got drug out of his truck and beat... then a marine comes running over to help him and they beat him up and he got kicked in the head. Is that still the story?

I can tell you that the corps doesn't like any marine giving them a bad name nationally though.
He'll be reprimanded in some way IMO.
