Yea, that thing is not going to work. If the site was prepped and it was just the BOP and a clean floor around it, maybe.

I don't think it's meant to sit on the sea floor. It's going to be suspended above the leak.

It is designed to sink in the mud/silt on the bottom. The end of the riser fits in the slot and the slot allow the cofferdam to sink in the mud up to those flaps. Thus trapping the riser in side.
