Your payment would have an ACH date on it coming from the Fed. If their system is down and you have a scheduled payment then the ACH file that BoA receives from the Fed will still be for the correct date assuming this payment was scheduled for the 16th and not just a payment made on the 16th. BoA cannot charge a late payment if your payment was dated from the Fed for the 16th but their systems were down.
