I'm not an expert on this portion of the case, but wasn't he given opportunities to return the documents prior to the indictment?
IIRC the Trump team was negotiating/arranging for the documents to be returned to the National Archives in compliance with the May 2022 subpoena for the documents to be returned. The FBI used security camera footage as well as "significant number of civilian witnesses" to get a search warrant. So Trump was given a chance to return the documents but the FBI also jumped the gun because the deadline to return the documents had not been reached.

Additionally - the FBI has visited MAL multiple times, confirmed SCIF security, made some recommendations on additional locks on certain doors which were implemented, etc, AND STILL pulled that horse shite in Aug 2022.
