I believe yes, because eBay's own policy is still 30 days if the circumstances are deemed worthy. This is actually why I still consider buying used off eBay, because I feel like I am still somewhat protected just in case there is an issue like this.
I think what happens first is you open a case for a return and the seller can approve, work with you, or reject it. And if it is rejected then eBay will make a determination/ruling.
I realize the return part said no refunds, but the listing itself still said like new. So this wasn't like an "as is" type of listing. I guess you could argue no refund is the same as "as is," but I find them to be a bit different. If the actual condition listed "as is" then I would definitely be against the idea of returning.
If I purchased something as is condition then even if it didn't work I would still keep the item. I would agree with that risk.
