State law says that neither “a postsecondary institution” (i.e. LSU) nor “an entity whose purpose includes supporting or benefiting such institution or its intercollegiate athletic programs” (i.e. TAF) can compensate an athlete for NIL.

I’m not sure there’s any distinction between LSU/TAF compensating athletes directly vs. paying an NIL collective that then compensates the athletes.

I’m also not convinced you can reasonably argue that the ticket holders are the ones actually paying the NIL collective if the athletic department/TAF are the ones implementing and collecting the fee.

I’m not saying it would 100% be illegal, but at that point you’re really opening yourself up to potential problems (keeping in mind that currently, the NCAA uses individual state laws as the barometer for what is/is not permissible).

I can certainly see the argument for taking a “consequences be damned” approach and calling the NCAA’s bluff. I guess it comes down to whether you think they’ll eventually make an example of someone.

Appreciate the info. I was wondering how collecting a ticket tax would be possible since NIL Collectives are supposed to operate separately from the university.

Again, appreciate the clarification. If a ticket tax can't be sport specific then it isn't a good idea. The vast majority would be generated by the football program only to see the additional revenue diluted for "equity".
