Sure there's some exceptions on rare vehicles and whatnot, but we're talking a pretty run of the mill subaru here.

So I looked into it more and it’s only true in about 2/3rds of states. Regardless, I didn’t realize it was true anywhere.

It has everything to do with buyers habits which has everything to do with how much a used car sells for.
You can disagree with me all you want.
But when someone returns an open package to the store, is that the specific one that you grab off the shelf?
Or do you grab the unopened one?
Legitimate question if you want to provide a legitimate answer.
The answer directly affects the number of qualified buyers for the product.
Supply and demand set the price.

I've done a few property claims in my day, and this is by far the closest so 100% that I've ever seen. It's usually significantly less.
Also, you can't ultimately fight anything. The insurance companies all use a program that does the calculations and provides the numbers. Even if you were to sue and go to trial, the courts pretty much always side with that program. And the insurance companies will not settle or negotiate, as not to affect the larger market.
