One has to be the offender otherwise there’s no crime. One has constructive knowledge of lack of consent and therefore wouldn’t be raped himself

Are you saying a person has to be an offender (via breaking laws) for a crime, or that ONLY one of the 2 can be an offender? Because the 2nd part is wrong.
