This law looks a little messed up. Are threesomes and above outlawed? Unfortunately I don’t have to worry.
Never mind. Unfortunately threesomes and up not being outlawed also doesn’t benefit me.
It is oddly worded though. 65 or older part could be moved to a circumstance under section A like the under 13 one and “where” then changed to “when” like 2nd and 3rd degree rape are written. I doubt paragraph B would have to clarify “participate”.

My buddy who use to work sex crimes for BRPD says he thinks they should be charged with 1st Deg Rape. He sent me this.
42. First degree rape
A. First degree rape is a rape committed upon a person sixty-five years of age or older or where the anal, oral, or vaginal sexual intercourse is deemed to be without lawful consent of the victim because it is committed under any one or more of the following circumstances:
...
(5) When two or more offenders participated in the act.

B. For purposes of Paragraph (A)(5) of this Section, "participate" shall mean:
(1) Commit the act of rape.
(2) Physically assist in the commission of such act.
