Agreed. That's why this doesn't rise to the level of a criminal case. The president can declassify documents without going through any formal procedure. The Brandon DOJ is arguing (I guess) that classified documents can only be declassified in accordance with the congressional statute. However, that statute conflicts with the president's inherent power to declassify. This entire thing is circular.
Honestly, I'm surprised that this is the argument Brandon wants to use in order to criminally prosecute Trump. I figured that Brandon and the Dems would focus on the Capital Protest, or that they would outsource their dirty work to the Fulton County DA and let her indict Trump.
