You are reading and representing that rule incorrectly.

That is the rule that allows eligibility BEYOND the 5 year window and allows for appeals.

It is saying that being academically ineligible for a year would be a negative factor in getting a waiver for eligibility beyond the 5 year window.

The 5 to play 4 is strictly a time measurement and comes with no stipulations.

and you are missing the bigger picture by not understanding that the applicable by-laws are inter-related and work in conjunction with other by-laws (just like the US Code). The academic suspension tolls on one of the four participation years. Our Firm just handled an NCAA appeal of a suspended student-athlete that the NCAA, itself, quoted this exact passage as the ruling authority in the case. So, I highly doubt that I am reading anything incorrectly.
