Considering the harm is death, and the benefit is a few months of spotty immune defenses verses a disease with a death rate of 0.2%, that's going to be a hard sell in court.

Moreover, there are different ways to approach a lawsuit. They might have complete immunity for producing and distributing the vaccine, but do they have immunity from lying to the public about the vaccine?
