B12 sends SEC letter saying it or any member institutions will not sue SEC or A&M

SEC votes A&M in

Baylor waits till just before the announcement before threatening a lawsuit

What has happened is that A&M had the big12 (i.e. Dan Beebe) sign a waiver which states the big12 and its member institutions will not pursue any litigation towards the SEC in regards to A&M pursuing membership.

Baylor has reversed their position and is saying they reserve their right to pursue litigation. The SEC has voted unanimously to allow A&M member ship on the condition that all big12 conference member sign this waiver.

The problem is, Baylor thought the big12 would survive when they agreed to the waiver on 9/2. since then, OU has stated they were uncertain they would remain a conference member, which threatens the very existence of the big12. Now Baylor is trying to block the SEC.

The problem is, A&M has already stated they ARE leaving the conference effective 6/30/12. Nothing they can do legally to prevent that. So, Baylor is acting in pure spite to try to make things difficult to allow us into the SEC.

The other problem is, Baylor's threat of litigation has ZERO merit. None. BUT, the SEC doesn't want to be dragged into any type of court proceedings whether the the potential lawsuit has any merit.

Personally, I think A&M should call BU's bluff. Tell the SEC that A&M will cover any and all court costs for the SEC and let Baylor try to win in court. It will fail for them and will easily be dismissed.

At this point, I dont know whats going to happen. A&M WILL NOT be in the big12 next year regardless of what happens.

The final note: TAM is allowed into the SEC on the condition that no other Big 12 school be offered to join the SEC.

So it looks like West Virginia will be the balancing member on the East side.

Slive got permission from the SEC members that he could talk to Missouri and West Virginia to balance the conference, but since Missouri is in the Big 12, that would leave only West Virginia as a possible member.
