This is more legal posturing than anything.
I do think there’s a nontrivial case to make that when you abruptly fire someone, leak a bunch of sordid news about their lack of work ethic and possible morality clause violations, and then retroactively claim the firing was for cause, you probably do make it harder for them to find a job and mitigate the buyout.
Is that the main cause of any difficulty he might be having? I highly doubt it. I suspect his mediocrity on the field and his age are the bigger issues. But could it contribute to say, 5, 10, 20% of the problem, which would result in some partial enforcement of the buyout even if he doesn’t find work? It could. And would that be enough to get a more favorable settlement, which this is really about? Likely.
I think that’s all it is. Posturing for settlement negotiations.
