I'm not saying that this a slam dunk violation of the first amendment, but the first amendment most assuredly protects people from more than just the threat of arrest.

Absolutely. But that doesn't meant that the first amendment "only protects the freedom to speak, but not the consequences of the speech." That is asinine.

I definitely do not agree with the message of the frat members but for the university to expell them is utter bullshite. Back when I was at USL in the mid nineties and worked in the education office we had a guy who was majoring in secondary education who was the head of the local Knights of the White Camellia (version of the KKK). He actually had a show on the local public access channel. Now no one agreed with the shite he was spewing but they didn't expell him over it either. Hell USL allowed him and his group to distribute literature ON campus because of the fear that by allowing other groups to do this and not him would be a violation of his 1st amendment rights.

It's simply a case of debate, nothing more. Unfortunate for all players all the way around from family to frat to administration.
The only way I could fathom this going forward is in a pro bono manner from someone willing to publicize the event in court on behalf of their ill conceived gain (game). I wouldn't doubt for a second the parents have been contacted many times but it's not in the interest of the boy(s).

Question for the attorneys:
According to Volokh Conspiracy, the students' expulsion from the University is a clear violation of First Amendment and Due Process rights. Could these students, and possibly SAE, sue the University for defamation and possibly win an award?

I just got to ask how dumb this chapter is as a whole. Obviously they're racist and horrible, but did one brother, even if they were shitfaced heading to Dallas, scream "Shut the frick up you idiots! Half the people on the bus aren't members of the chapter!"?
Seriously, if I was a chick and wasn't dear friends with any of the actives, I'd certainly consider recording the event wondering what the frick I was thinking going down there with these idiots. It was just plain old stupidity and not just drunkeness as a collective whole that they all started screaming this well reversed rendition of hanging black people.

I would think the OU president and powers that be would have already run the expulsion of the students by a legal team...doesn't mean they won't sue but I would guess OU had every right to expel them.

Do you know this from personal experience? Bc I know two ppl that were expelled, one gave up on trying to get into another college and it took the other 4 years to do so.
Getting expelled is pretty few and far between when it comes to college. It is usually saved for severe cheating cases and in cases that involve violence and physical harm that has aggravating circumstances.
