Lawyer could make the point that the limits on charging certainly should apply to executing a sentence.

This. Legally, he must do his time.

But, I'm still wondering if this violates the 8th amendment. It seems pretty cruel and unusually to wait over a decade to make a guy serve his time.

He'll end up making a deal for less than a year. He may have gotten out for good behavior after a few years anyways

How do you mean? I would assume that the only thing he can do is either nothing (in which case he's not doing his job) or send the guy away to serve his time. Does he have another option?

Sounds like the situation is out of the hands of the DA. He has done is job. I don't know Missouri law, but it seems like it's up to the court and/or the government.

DA is a political position. This sort of thing sucks when you're the one filling the position, instead of just one of us who "Knows what is right."

And this is coming from someone who thinks they should let the guy go if the facts are as presented.

The DA is doing his job. We have a system in place to deal with situations like this. Best to let the system work.

Sounds like he's an upstanding citizen in a society now. Not a leach on our taxes like so many criminals and convicts.
