Other way around. It's still an enumerated power of Congress listed in the Constitution, Article I, Section 8.

That's how our system works, right? If you're accused of a crime, the burden of proof falls on the State. Same for a lawsuit. The person bringing the suit has the burden of proof.
And if you want a judge to issue an injunction ...
