Other way around. It's still an enumerated power of Congress listed in the Constitution, Article I, Section 8.

How many of those cases allowed discovery?
You mean in how many of them did Trump's lawyers ask for and convince the Court to grant it?
You've got to make a case to get expedited discovery you know.
That's my point. Trump's lawyers couldn't make a case to get what they wanted, and the burden was on them.
Sucks, but that's our system.

That's how our system works, right? If you're accused of a crime, the burden of proof falls on the State. Same for a lawsuit. The person bringing the suit has the burden of proof.
And if you want a judge to issue an injunction to overturn an election, you gotta have some evidence of serious fraud.
President Trump had his day in court. He lost something like 50 or 60 cases.
