The way to fix this is to scrap NIL and move to a profit sharing model standardized across the NCAA.

Every scholarship player gets a flat check. Preferred walk on get half. Official starters get a starter bonus each game. Award winners get a bonus each award they win to reward elite players. (This includes conference players of the week and position players of the week. Conferences can not create new awards unless all conferences agree)

I rank bad losses much higher than good wins, so I would keep both of them out due to FL and FSU losses.

But Bama has a far stronger case than Texas. They have the best win in CFB from winning over Georgia. They have better, more consistent QB play. And their bad loss was out of conference which short circuit's Texas's main argument because FSU was a tough opponent when they were scheduled.

I'd have left Bama out, but I can understand their inclusion. There's no scenario where Texas is deserving.
