Help with phone activation

I have service through AT&T. My son's phone was stolen so I bought him one on eBay, which the seller told me is locked to AT&T. I took it to the AT&T store to get it activated and they told me it's locked and they can't switch my son's number to it. What am I missing here that I need to do? The lady at AT&T wasn't very helpful.
