Not sure how it works in England, but here its pretty hard to defeat freedom of the press. Even in a situation like this. He's a public figure so he has a much smaller expectation of privacy. He exposes himself to the public daily, so he would be pretty unlikely (at least by American laws) to be successful in a lawsuit.

Correct me if I'm wrong SB lawyers. In order to win a slander/libel lawsuit, doesn't the plaintiff have to prove that the publication's content resulted in a loss of income, or something to that extent.

Strange article to say the least. As always, I enjoyed reading Barton's reaction. Martin Samuel is actually one of the more highly respected English journos which makes the article all the more strange.

If Barton embraced the article would he be this boards new icon?

Well you need to prove damages. That would be a form of damages. Another (in this situation) would be something like estranged marriage with his wife or ruined relationship with his kid. That would take the form of "mental anguish" or "emotional distress." Even something like a loss of sponsorship money or loss of donation money to a charity Joey heads up could be considered damages.

Yep, the burden of proof is on the one seeking the compensation.
