Then he can make the argument in court that he declassified them while still President and provide proof or witnesses to that fact. If he can’t, that defense won’t hold up.

This is the problem he has though. For him to argue they are declassified, he’s going to have to testify to that fact. Do you think his attorneys are chomping at the bit to put him on the stand and subject to cross examination?

Even if he does testify to that fact, if he has no evidence, witnesses, paper trail, or anything backing him up, then it’s hard to see a jury buying it. He has to have proof. Let’s see if he does.
