I think the issue comes down to "legitimate purpose". I googled looking for any jurisprudence and couldn't find any. I just don't think this could stick given the other person being present (lack or reasonable expectation of privacy), lack of nudity, sexual conduct. Frankly, if Rudy really had a problem with it he could make a complaint or simply allege it in the media. It appears none of that has happened.
