what entity put forth the requirement that a bulb had to get at least "x" amount (40??) of lumens per watt to make it "legal"? and why?

I promise you this is a fact....the LEDs you have that are 6 years old, regardless of application and manufacturer, have lost about 20% of their lumen rating if used in a normal residential application. That means they are about 20% as bright as they were when new. They also lose brilliance from the time they are turned on until they are turned off...they dim as they stay on....all LEDs do...and it is noticeable to the human eye in the same way that all AC bulbs switching off 60 times a second is noticeable....we do not acknowledge it but we know its happening and the eye responds. Incandescent lamps also degard over time but it is faaaaarrrrrrrr slower and can be non existent IF the manufacturers would do it...they do not dispute this, they openly acknowledge that they intentionally build lamps (bulbs grow flowers) which are designed to fail prematurely. LEDs offer more opportunity to design this failure into them...incandescent lamps are SIMPLE....as long as the glass is in tact and no air gets in they have and will last for many many many years.....

There is only one entity in the US which can make things legal or illegal and that is a government agency....in this case the Federal Government. Thats the easy part. The why is more complicated....but dismissing lobbyists from the equation is a fools errand....it is pretty well documented.
