Where did you get this from the article? The cops are the ones who make the arrests. The DA is the one who decides whether to prosecute. Usually the jury decides innocence or guilt. Judge plays a role in determining what evidence may or may not get admitted, but according to the defense attorney quoted in the papers, they said Judge Leblanc was a fair judge and often went against The State.
