Help, selling a car in la that is from out of state

We are selling a car to someone here in la. However the car was last titled and registered in fla. Will it cost the buyer more because of this due to fees or taxes?? lets say wee are selling it for $1000. Or we can do an act of donation if needed.

The buyer has very limited funds ( living in a shelter) so we are trying to ensure she does not have any extra fees. We are trying to gather the info she needs so she is aware of everuthing.


Yes, i know google exists or i could call the dmv. However i need a quick answer and the 3 numbers for dmv\ title transfer all had no longer in service messages. The OT knows their shite so i chose the OT and their infinite wisdom. Thanks

I'd imagine you can gift it to the person. I believe you can gift an individual up to $14000/year before it is taxable.

If you live in Louisiana and have an out of state title the new owner will be double taxed plus pay 80.00 twice for a title they never receive.

if you are out of state and have drivers license new owner just needs front and rear copy of it to get title in there name.

also if its out of state and title doesnt have bill of sale on it the new owner need a bill of sale

We figured that but is there a flat fee type thing that happens regardless of if you donate it?

You should be able to sign over the title to the person you are selling it to and will have to get it notarized (whatever that fee is) and they will need to go get title/registration and license in state of LA which is $76.50.

Nothing will change for the buyer. However, is this car valued around $1000? Or are you "selling" it for $1000 to lessen their tax burden?

Louisiana taxes vehicle sales on the FMV when the price is in question.

If you're worried about taxes and/or fees for the recipient, use the Act of Donation form.

Please read this out of state titling law. out of state titling in louisiana is total BS

If the documents were notarized out-of-state, the file will be acceptable, since it is assumed that the registered owner shown on the out-of-state title is not a resident of Louisiana. Several states do not require notarization of all or some title transfer documents. If an un-notarized bill of sale is received but the assignment of title from the registered owner is notarized out-of-state, this will suffice as proof of nonresidency of the seller. If neither the bill of sale or assignment of the title is notarized, a notarized affidavit is required from the registered owner indicating that he is not a resident of Louisiana. The affidavit MUST include the out-of-state address. If the documents submitted were notarized in Louisiana, it is assumed that the registered owner shown on the out-of-state title has become a resident of Louisiana and must pay use tax. A "double transfer" will be processed and tax are due on both transactions. An affidavit of non-residency or a copy of the seller's out of state driver's license/identification card will be accepted as proof of residency.
Exemptions from this procedure will be acceptable if:
the registered owner listed on the out-of-state title provides a notarized affidavit of nonresidency in Louisiana and states his true out-of-state address; or
the registered owner listed on the out-of-state title presents his out-of-state driver's license.
an international driver's license shall not be accepted as proof of out-of-state residency.
If the vehicle is less than ten (10) years old and the back of the out-of-state title does not contain an odometer disclosure statement, a supplemental odometer statement must be submitted.
If a dealer acquires a vehicle with an out-of-state title for resale purposes, an affidavit to this effect is required from the dealer.
An out-of-state title indicating alternate ownership may be transferred with one of the titled owner's signatures if only one signature is required by that jurisdiction.
All files with a date of sale on or after August 1, 2012, must include a copy of each vehicle owner's current and valid photo identification. The photo identification provided should be a driver's license or identification card issued by this state or another state. If an acceptable form of identification cannot be provided, a title will be issued however a plate will not be issued until identification is shown.

Note:
An out-of-state title with the brand of "Bonded Title" or "Bonded Vehicle Title" cannot be accepted for any type of title in this state.
Any person who is a new resident of Louisiana shall apply for a title and/or registration for each motor vehicle he owns and operates on the public streets of Louisiana within thirty days of the date he establishes residency. The date a person establishes residency shall be the date he/she is issued a Louisiana driver's license.

Thanks everyone.

The car is worth about 2000 so the 1000 price is legitimate for its true value. We will likely do the act of donation as it is acceptable due to the cars age ( over 15 years old ).

The seller has a fla drivers license so i am not sure how that affects the situation. Ive been recovering from surgery so my mind isnt so sharp this week. Im neither the seller or buyer, im just helping them get the deal done.

We are off to the notary now. Buyer is very happy with car as are the 2 friends she brought to inspect it.
