fwiw, you don't need to "file suit"...just get in touch with them and tell them what happened, as folks who do that kind of work hear that kind of bullshite all day long.
also fwiw, if you went around a barricade and drove in wet cement, you can probably expect to pay for the rework of the cement....just sayin....
