It's already been said, but the team took a vote. ML voted on releasing them, Axe voted on killing them, Dietz abstained saying "It doesn't matter to me. If you want me to kill them I'll kill them. Your call". Murphy sided with ML (probably cause it was the moral thing to do and him and ML were best friends).
I thought it was a very good movie, but it differed greatly from the book in my opinion. Even their deaths weren't the same as in the book. Nor his rescue..
As far as the goat herders go.. I would have voted to kill them. They were obviously Taliban supporters. Due to the R.O.E. however they could not LEGALLY do it. In his book ML even talks about his hate for the current R.O.E. and how it directly got his team killed.
