So if I join a business organization...and they convert my funds and steal my money...I have no civil recourse against them for damages because I agreed to join?
If you pay dues at a Fraternity in your college and they haze you and you fall off the roof and break your neck, your family has no recourse against the chapter for wrongful death because their son paid dues?
Just because you agree to jump out of an airplane and sign "I assume the risk and understand skydiving is dangerous" doesn't mean the skydiving company isn't liable for negligence if there is no parachute in the backpack when you pull the ripcord at 15,000 feet.
