We had the same problem and I think I found out why. I bought a temp stick to monitor the temp because wife keeps breast milk in there and was paranoid about losing it. Anyways, temp stick was reading 6-7 degrees warmer than what I had temp set at. So instead of 38, the real temp was in mid 40s. I backed my fridge down to 34 and now my temp reads 39-40, problem solved.
