I review background checks for some hires we make and as long as it's not something that is a do-not-hire offense that companies have depending on the field, usually HR or hiring managers are looking for some background on the charge to see if there is some understandable circumstance there before proceeding (which they usually do)
They're not looking to hear that you hired a lawyer to take care of it or that you haven't been proven guilty of anything. They can see that part from the background check and hear that all the time. You may have done this already, but just explain the situation if it wasn't anything major and it was understandable given circumstances since nobody is perfect.

Thanks for this post. A close friend of mine, his wife works in HR for BP in Houston and she told me pretty much the same thing, BUT she said that every company is different and you never know how strict they are on these things.
However she did say that rescinding an offer, especially after they have moved as far forward with me as they have, is very expensive for the company and its generally a last resort. She doesn't think the company would be willing to pull my offer for something I haven't even been found guilty of, and even if I was, she thinks its low level enough considering I have zero criminal record otherwise. She said at BP they have hired people with far worse criminal records.
She said background checks, especially those done by a 3rd party like mine is, they don't pass or fail you, they just give a report to your employer and assess the new hire a level of risk and its up to the company to take that risk level given to them and make their decision. However, it wasn't the 3rd party background check company that contacted me today to get details, it was someone from the company I got hired by.
