If I were the bureaucrat who had to make the call here, I'd look at how frequently the house has been booked on AirBnB, but I'd also look at simple availability. I mean, if I can go on AirBnB and book this place for some weekend 6 months from now, then that's a pretty solid indication it's not these people's permanent residence.
I'd also suggest that this whole situation is just evidence of what a drain local governments are on all of us. Originally the states, counties, cities, etc. had some measure of autonomy when it came to making the law reflect local values. That's been eroded over the years, by the Civil War, by the federal funding of highways and schools, and by who knows what else. Local and state government in 2020 has turned into a mechanism for picking our pockets and perpetuating poverty.
So in that general sense my sympathies are with this family.
