I am not a lawyer and I have never played one on T.V..

I think this is all bullshite but I do have a question. Are the judges actions predicated on the fact that he already plead guilty and therefore no prosecution is required, only sentencing?

It certainly complicated things. Flynn stood up in open court, under oath, and admitted to the factual predicate of the crime.

Now the judge is being asked to set that aside by the defense team and the government is now saying “hey, all this stuff we’ve said and done for 3 years, don’t worry about that” and dismiss the case outright.

My guess is Sullivan will allow the public to weigh in, chastise the DOJ publicly at a hearing, but eventually dismiss it as requested.

What if his guilty plea was a result of blackmail? Didn’t FBI threaten his son?
