Supposedly, this aid from the government is meant to cover the expenses of small businesses to pay their employees so they don't suffer wage losses, allowing them to come back and basically hit the ground running. So if the small business doesn't hire back a certain employee or employees, maybe they have a reason to sue.

This is where a lot of greedy business owners will get hammered. If they dont rehire or fire people because of anything involving the virus that grant is no longer a grant, it will remain a loan. A loan many of them will not be able to afford.
