Kavanaugh was asked this during his confirmation hearing by Lindsay Graham and said it was legal to try civilians there.

Seems to me that anyone ever on trial for treason could be tried via military tribunal. I'm not a legal expert by any means, but the very nature of the charge of treason should fall in the jurisdiction of the UCMJ.
