Take out either of those variables, and this case never exists

I guess the SC could deem the state law unconstitutional somehow, but they don't want to touch it

But the gays weren't discriminated against....

If I'm not mistaken, she didn't refuse to serve them because they were gay. She would happily make them a cake. Just not the cake they wanted. She would have made them a plain cake, would she not?
