It was a shitty situation. His duty was to protect those kids. Court case wise, the USSC says he has no responsibility to defend those kids. Criminally, I would think malfeasance in office(he's sworn in as a LEO), dereliction of duty, criminal negligence could all be brought up. I'm not a lawyer though.

That's a pretty big hurdle to overcome

Malfeasance requires act of corruption

Dereliction of duty not a law

And criminal negligence is a stretch due to a lack of recklessness act by the officer
