Florida has dram shop laws. I am not familiar with the nuances of the Florida code but many of them attach strict liability to over service. It would be interesting to know how the FL law or court might view an employee vs a patron. Louisiana doesn't have dram shop laws.
I only tried one of these cases but the dram shop aspects were secondary to police procedure. Guy got rowdy in a bar and the bar kicked him out and called the cops. The cops made the guy's friend who was going to drive him home leave the scene then they didn't arrest the drunk kid and just let him go. The kid stumbled off and fell of a train trestle and drowned in 3 inches of water.
