Not necessarily. If the guy got out of his car, was in the lane at all, and it was dark then it’s plausible Boeheim didn’t see the guy until it was too late. Sadly, it happens here all the time when people break down on the interstate and start walking to the ramp.

nearly hit a hitchhiker on my way home from work at 1:30 AM one day b/c he was walking in the lanes of travel as I was coming around a curve... I barely swerved to avoid him
