It is a crime when it’s to the fbi. Which is why Flynn was prosecuted.
But it’s very likely he gets no time because of cooperation

Why then are FBI interviews not recorded? Why then are 302's, written by FBI agents themselves, the only contemporaneous recording of what happened? If a podunk cop has to record an interview with a podunk crook in a podunk town, why is it that the most powerful law enforcement agency on Earth is exempt from the same standards?
People are pissed at how easy it is for someone to be charged with a federal process crime, have your entire history combed through and then be railroaded to plead guilty to a crime you didn't commit under the threat of decades of imprisonment for other alleged crimes that would've never come to light but for the bullshite process crime.
