Would likely depend on where exactly you hit him. If you directly rear ended him, they will likely say that you are at fault because you had time to stop. If you hit him anywhere on the side of the car or even the side of the bumper, he will likely be at fault for failing to yield.

A friend got rear ended and was at fault for pulling into traffic.
I don't have all the facts. But that's what the insurances went with too.
