I don't believe that Cohen didn't discuss this with Trump.

The reason they saying they didn't talk is due to the FEC violations that it might incur. Even with Cohen going rogue and paying this, it might be a FEC violation.

FEC violations are difficult cases to prove. I doubt Cohen gets charged for FEC violations, but only the SDNY knows for sure. I think its more likely that he gets charged if there are a ton of women that he orchestrated payoffs for. Avenatti says 6 other women have come forward. Who knows if their cases are legit though.

One would think that a client that uses his lawyer as much as Trump uses his paid more than enough in legal fees through the years that Cohen would simply write the $130K off as a business expense and go on, without directly billing Trump for it. And as far as I know, there is no legal obligation to note such an expense as "money paid to whore to keep quiet about client fricking her" he could have simply billed it as "legal expense" and went on.
