That's an interesting question. It guess it would depend on whether one is still considered to be in control. The law does say "operating any means of conveyance". I know that you can't get a DWI on a horse because a horse has a mind of its own. Perhaps if the artificial intelligence operating the self driving car were deemed to have its own mind, then maybe you would be free from a DWI.
