That's an interesting question. It guess it would depend on whether one is still considered to be in control. The law does say "operating any means of conveyance". I know that you can't get a DWI on a horse because a horse has a mind of its own. Perhaps if the artificial intelligence operating the self driving car were deemed to have its own mind, then maybe you would be free from a DWI.

Actually a pretty interesting question. Driverless cars in general are going to change a lot about the world in areas all the way from infrastructure spending and standards, car manufacture regulations and the civil and criminal justice systems. Exactly how the landscape changes remains to be seen with how exactly the technology evolves in between now and when these cars are in mass use and these issues actually begin to arise. I'd imagine specific to your question it is something that state and federal legislature will have to examine depending on the level of control one can have over the vehicle when it's in "driverless" mode or otherwise.

Of course, but I wonder how they will determine if you are drunk. Your car is driving perfect. They'll probably make every car have an interlock with a portion of those profits going to local municipalities.

But without DUIs or traffic offenses, we won't need as many cops. We could actually pay cops to, you know, solve and prevent crimes.
