You can't impound a dog for attacking another dog in it's own backyard.

WTF makes you think this? They were in a shared area obviously. I'm positive the city has leash laws and probably the association (if one exists there)
Regardless, when there is a dog bite, it is standard yo have the dog checked and or quarantined.
If I go to your house for coffee and your dog bites me your dog will be impounded for this if I make a complaint.....end of story
