If this were a civilian, said person would be in custody with a murder charge. Whether or not the gun misfired and a lesser charge is warranted would be a detail for the DA's office and the civilian's lawyer to work out before trial.

Here, the cops aren't charged and they're on PAID leave. They killed a woman for no apparent reason and are still getting a paycheck directly funded by taxpayers. And many on here still act shocked that a significant portion of Americans hate and distrust police.
