That is flat wrong. You might be thinking of a Flexible Spending Account, which is money set aside solely by your employer fo ryour use during a defined period.

You own your HSA and can't lose that money. If I don't use it on medical expenses, I will get taxed on it, but it's tax free money right now anyway.
