And one gets you locked up and one gets you a citation. So what's your point? Most police departments I know of in America don't throw laws out because they don't agree with them. Same goes for officers.
But you get to pick and choose what laws to follow. And sometimes this happens.

Citations are discretionary in enforcement. Most of us are wondering why a warning, and an educational moment of the law was less appropriate than a ticket and a fine for someone not wanting to be in the cold while waiting for a vehicle to warm up. It's an odd way to be a peace officer in the community.
