I'm no lawyer, but isn't that kind of assault considered a tort which isn't punishable by jail time? If he was taken into custody it would be for a criminal offense which indicates he did hit someone.

depends on the state. In Michigan, where this incident happened, sort of. For an assault, it requires an attempt to cause injury or it requires something like brandishing a weapon or raising a fist whereas the threat causes the victim to reasonably believe the violet act will occur. Battery comes into play if the threat of violence is actually carried out.
