B/c police need a catch all charge for people not "respecting their authoriti"?

Most "resisting arrest" charges are a result of insubordination, not actually resisting arrest.

"Sir, I'm going to need you to go sit on that curb."
"Am I under arrest?"
"I need you to go sit on that curb"
"Why, am I under arrest?"
"GO SIT ON THE frickING CURB!!"
"Dude, I just want to..."

"HE'S RESISTING! TAKE HIM DOWN! PUT YOUR frickING HANDS BEHIND YOUR HEAD!"

Charge = resisting arrest.

Also, if the arrest is unlawful, then resisting the arrest is not against the law. That doesn't address the question of whether it's a wise thing to do, but nevertheless, it's legal to resist an illegal arrest.

For some mysterious reason I've never been arrested. Then again, I don't argue with the cops. I just speak respectfully and politely and save any arguments I might have (if any) for a judge later.

Somehow the police just never take me in when I do that. Funny how it works that way, isn't it?

So when an officer tries to stop and/or check you and you resist, you are resisting arrest
