Speaking from experience being forcibly involved in a very similar situation with my Brother in Law,
This. Keep a log/journal. Record all you conversations. Keep receipts for every dollar you spend on the kid.
Does the mom have a vagina? If so,
My BIL's baby mama is a terrible human being that still has custody entirely because she has a vagina and the court system is so ridiculously biased towards vagina it borders on absurdity.
If he goes and takes the kid, she will call the police and he will go to jail. Why? See above.
Best thing for your buddy to do is to get good representation, take lots of notes, photos, etc. Follow every conversation he has with his ex with a Text. Record conversations. And hope you can get a judge thats not a complete arse clown.

In Louisiana, this is blatantly false. They are still married and their is no custody agreement in force. As mentioned in prior posts, This is a civil matter. Now if the father takes the child, moves cross country and changes his last name that's a different story.
